Here at Equispace, we want you to understand what information we collect, and how we use and share it. That’s why we encourage you to read our Privacy Policy. Protecting your private information is our priority. This Privacy Policy applies to Equispace Media LLC, (together with its affiliates, “Equispace,” EquiSpace Arena Records, “we,” “our,” or “us”) collection, use, disclosure, and other processing of personal or sensitive information that you provide to us or that we collect via access to and use of our websites which include, equispace.net, equispace social, equispacerecords.com and any text, media, documentation, pictures, videos and other content provided through our websites (collectively, the “websites”) Your use of the websites and mobile apps (our “Services”) shall be at all times subject to this policy and our terms of service located at https://www.equispace.net/terms-of-service (“Terms”). By using the EquiSpace application, you consent to the data practices described in this statement.

What kind of Information we will be collecting 

To better provide you with products and services offered, EquiSpace may collect personally identifiable information. We collect the content and other information you provide when you use Equispace, including when you sign up with Equispace, enter an event posted on Equispace, message or communicate with others. Information such as your: first and last name, location, address, state and county of residence, email address, photos, username and password, phone number, and any other information you provide to us when you create an account to log into our network or use our services (your “Account”). If you use our mobile application on your mobile device, we may collect your phone number, mobile software and hardware information, and unique device ID number. We will collect your profile photo and user name that you upload to your public profile page through your account. When you participate in certain events, your profile information about the event, rider, your horses, including your performance results, points, standings and earnings will or may be publicly available.

If you purchase Equispace’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. All financial transactions via the services are conducted using a third-party payment processor. All such transactions are governed by the vendors’ respective terms and privacy policies, which we do not control. We encourage you to review their applicable privacy policies and terms before submitting payment information.

Use of your Personal Information 

EquiSpace collects and uses your personal information to operate and deliver services you have requested.

EquiSpace may use personal information for purposes of administering our business activities, providing customer service and making available other items and services to our customers and prospective customers.

Equispace may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (name, email, address, telephone number) is transferred to the third party. EquiSpace may share data with a trusted partner to help perform statistical analysis, send you email or postal mail, and provide customer service. All third pirates are prohibited from using your personal information except to provide these services to EquiSpace, and they are required to maintain the confidentiality of your information.

EquiSpace may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to; (a) conform to the edict of the law or comply with the legal process served on EquiSpace or the site; (b) protect and defend the rights or property of EquiSpace; and/or ( c ) act under exigent circumstances to protect the personal safety of users of EquiSpace, or the public.

How we Share Information with Third-Parties 

At Equispace, we work with third parties to promote and better equestrian activities and services to help us provide, advertise and improve events. We may transfer information to vendors, service providers and other partners who support Equispace, such as providing technical infrastructure services, analyzing how Equispace is used, measuring the effectiveness of ads and services, providing customer service and facilitating payments.

Cookies 

We may use cookies to collect information about you while using our services. We may use both session cookies (which expire once you close your web browser) or/and Persistent Cookies (which stay on your computer until you delete those cookies) to provide you with a more personal and interactive experience on our Services. This type of information is collected to make the services more useful to you and to tailor your experience to meet your special interest.

How do we handle information about children under 13? 

At EquiSpace we respect your right as a parent to protect information about your children, particularly if they are under 13 years old. We know that you have children who may participate in activities available on EquiSpace. We do not allow children under 13 to have a EquiSpace account. In order to participate if they are under 13 years old, they must participate on a parent or guardian’s EquiSpace account. Special provisions apply when you provide information about your child under 13 years old.

You may be providing this information to allow your child to register for, participate in, or compete in an offering by a EquiSpace partner or otherwise create a record for your child on EquiSpace. You may be providing the information directly to EquiSpace, or you may be providing it to the EquiSpace partner who then shares it with EquiSpace. The information may include your child’s name, address, age, date of birth, email address, school, interests, photos and videos that are uploaded. Some information may also be information such as competition results, photos or videos obtained during an event.

The information about your child may be used to provide a history on EquiSpace for viewing by you, your child, or others allowed by you. The information also may be used to register your child for an event, participate in a competition, or post or share for viewing by others.

Your consent as a parent is required to obtain information about your children under 13 years old. In many cases this consent will be verified by your use of a credit card, debit card, or other online payment system that provides notification of each separate transaction to the account holder. Alternatively consent may be collected through an individualized agreement with you.

To create an account, you must be at least 13 years old and you must provide truthful and accurate information about yourself. Don’t try to impersonate anyone else when you create your account. If your information changes at any time, please update your account to reflect those changes.The Site is intended for users who are at least 13 years of age unless permission is granted by a parent or guardian. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site. In the event that Equispace confirms lying of age without permissions your account will be disabled until correct permissions are obtained.

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that EquiSpace is not responsible for third party access to your account that results from theft or misappropriation of your account.

EquiSpace respects your rights to maintain and manage the personal information of your child. You are always welcome to review the information that has been posted on EquiSpace about your child and request that any of the information be deleted. You may also request that EquiSpace stop collecting information on your child. Please contact EquiSpace at in**@eq*******.net to allow us to help you manage your child’s information.

Location Services and tracking 

By agreeing to this Privacy Policy, you are agreeing to allow EquiSpace to turn on location services on your device(s). We use location-related information, such as your current location, where you live, the events you attend to personalize and improve our services including ads, for you and others.

Email Communications 

If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. From time to time, EquiSpace may contact you via email for the purpose of providing announcements, promotion offers, alerts, confirmations, surveys, and/or other general communication.We may periodically send you emails that contain information about events or various products and services we feel may be of interest to you.  In order to improve our services, we may receive a notification when you open an email from EquiSpace or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email from EquiSpace, you may opt out of such communications by clicking on the unsubscribe link in the email.

CAN-SPAM Compliance

In compliance with the CAN-SPAM Act, all e-mail sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.

External Data Storage Sites 

We may store your data on servers provided by third party hosting vendors with whom we have contracted.

California Privacy Rights

If you are a California resident, then you also have the following rights under the California Consumer Privacy Act (“CCPA”) regarding your personal information.

  2. Equispace Does Not Discriminate. We will not discriminate against you for exercising your rights under CCPA, including by denying service, suggesting that you will receive, or charging, different rates for services, or providing a different level or quality of service.
  3. How to Exercise Your Rights. To exercise any of your California access or deletion request rights, please submit a verifiable consumer request to our contact email address at the bottom of this policy. To the extent applicable, we will contact you to confirm receipt of your request under the CCPA and request any additional information necessary to verify your request. We verify requests by matching information provided in connection with your request to information contained in our records. You may also designate an authorized agent to make a request under the CCPA on your behalf provided that you provide us with a signed agreement verifying such authorization.

Equispace Media LLC makes no representations, warranties or assurances as to the accuracy, currency or completeness of any information contained in or on Equispace or any sites linked to this site.

All material on this site is provided “as is’ ‘ without express or implied warranties of any kind, including warranties of merchantability, noninfringement of intellectual property or fitness for any particular purpose. In no event shall Equispace Media LLC or its agents or associates be liable for any damages whatsoever, (including, without limitation, damages for loss of profits, business interruption, loss of information, injury or death) arising out of the use of inability to use the material.

Disputes   

We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it’s useful to know up front where it can be resolved and what laws will apply.

You and EquiSpace each agree that any claim, cause of action, or dispute between us that arises out of or relates to these Terms or your access or use of the EquiSpace Media shall be resolved exclusively in the U.S. District Court for the 12th Judicial Circuit Court of Florida or a state court located in Sarasota County. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of Florida will govern these Terms and any claim, cause of action, or dispute without regard to conflict of law provisions.

Changes to our Privacy Policy 

Equispace reserves the right to change this Privacy Policy from time to time with or without notice. If we change our Privacy Policy, we will post those changes on this page to keep you aware of what information we collect, how we use it and under what circumstance we may disclose it. Changes to this privacy policy are effective when they are posted on this page.

Subscription Terms of Service

TO FULLY ENJOY FULL ACCESS TO EQUISPACE RECORDS YOU WILL NEED TO SIGN UP FOR OUR SUBSCRIPTION SERVICE. YOUR USE OF THE SUBSCRIPTION CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO BE BOUND BY THIS AGREEMENT AND OUR TERMS OF SERVICE.

Monthly Subscription By purchasing a Monthly Subscription, you agree to an initial and recurring monthly subscription fee at the then-current monthly subscription rate and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel your subscription at any time, subject to the terms of our cancellation policy.

Automatic Monthly Renewal Terms

Once you subscribe, Equispace will automatically process your monthly subscription fee each month at the then-current monthly subscription rate, until you cancel your subscription. We explain how to cancel your Monthly subscription below in the Section “Cancelling Your Subscription”

Cancelling Your Subscription

There is no long-term commitment attached to our monthly subscription service, you can cancel your subscription at any time by contacting EquiSpace Admin by email at in**@eq*******.net with your email address and full name. We do not offer any refunds of any kind.

Unpaid Charges 

If any fee is not paid in a timely manner, or your transaction cannot be processed, we reserve the right to suspend, disable, cancel or terminate your access to our service and/or cancel your subscription. 

If your credit card expires or your payment method is otherwise invalid, we do not automatically terminate your account and you will remain responsible for all charges and uncollected amounts incurred until you cancel your subscription according to the “Cancelling your Subscription” section or we, in our sole discretion, decide to terminate your account.

Our Cancellation of Rights

Equispace may suspend or terminate your subscription, without refund, if you breach any of these terms and conditions, or in the event of any verbal or written abuse of any kind (including abusive, offensive or aggressive language) directed towards EquiSpace, any EquiSpace Member, or any member of the public, with or without notice and without further obligation to you.
